In many states, a driver who is under the influence of alcohol can be charged with a DUI (Driving while Under the Influence). In Missouri, a DUI is the same thing as a DWI or BAC.

A DUI in Missouri can be issued when a driver is intoxicated or drugged while operating a motor vehicle. DUIs can also be issued for drivers that are determined to have a blood alcohol level of 0.08% or higher by a blood, breath, or urine test.

DUI offenses can be very serious, and an experienced St. Louis DUI attorney can help you if you are charged with a DUI, BAC, or DWI in Missouri. The consequences for your first DUI (Driving Under the Influence) offense can include:

If you are pulled over by a police officer, and asked if you have been drinking, you are not required to answer any potentially incriminating questions. Thus, if you are asked if you have been drinking, it is perfectly all right to answer with “I’d like to speak to my attorney before answering any of your questions.” Also, you may want to say that you have had a couple drinks, because it is perfectly legal to drive after consuming one or two alcoholic drinks depending on your weight.

Also, you are not required by law to participate in any field sobriety tests or chemical tests. However, if you do not take a chemical test after being arrested, then you could lose your license for up to one year, and the refusal could be used against you as “consciousness of guilt.”

The bottom line is that a DUI charge is a serious offense, and it is a good idea to have a qualified Missouri DUI attorney represent you if you have been charged with Driving Under the Influence. If you have been charged with DUI, DWI, or BAC in the St. Louis, Missouri area, contact the law offices of Kevin J. Roach.
